HARRISBURG, IL (KFVS) - The jury trial against the former chief deputy of Saline County will no longer start the first week of November.

Todd Fort's sexual assault and official misconduct trial was set to start next week, but Friday a Saline County judge granted a request by Fort's attorney for more time.

Fort walked into court dressed in a jail issued jump suit and sat nearly motionless between his two attorneys.

Fort's Attorney Bryan Drew, told the judge he needed more time to hire an independent expert to test DNA recently provided by Illinois State Police. Drew also said he planned to hire a private investigator.

"From the results that I received from the Illinois State Police lab it appears that we need to do some additional investigation that either Illinois State Police have not done yet, or I don't know if they ever intended to do," Drew said. "I guess it will be encumbrance upon us to do that."

Drew told the judge he plans to hire those experts to identify an unknown male specimen found in the DNA results. The state has previously taken DNA from Fort to be tested.

Lt. Stan Diggs with the Illinois State Police says Todd Fort's DNA was overwhelmingly present in the samples.

Fort is accused of having sex with 17-year-old Bobbi Carrigan, who worked for him at the Saline County Sheriff's Office.

Since the judge granted dew's request for more time, Fort's trial will not start next week. Instead Fort is expected back in court for another pre-trial January 14 at 9:30.
