Clay Waller posts bond, in custody of US Marshals

CAPE GIRARDEAU COUNTY, MO (KFVS) -

According to the Cape Girardeau County Sheriff's Department, Clay Waller posted bond on Friday.

Although we're told he is not on the streets, he is in the custody of US Marshals.

Waller's attorney, Scott Reynolds confirms that Waller is being held on federal charges.

Reynolds tells Heartland News that they made the decision to bond him out early Friday morning because they knew the charges were coming.

Reynolds also says they could not address the federal charges until he bonded out on the state charges.

According to Assistant U.S. Attorney Keith Sorrell, Clay Waller was taken into federal custody Friday Afternoon.  He's charged with making an Internet threat.  

Jacque Waller's sister Cheryl Brenneke confirms the charges stem from a threat Waller allegedly made against Brenneke via the website "Topix".

Waller's attorney Scott Reynolds tells Heartland News that he and his client knew the federal charges were coming.

They bonded him out of jail knowing he was going to get re-arrested.

Reynolds says he couldn't address the federal charges, until Waller was no longer being held on the state charges.

Sorrell says Friday's arrest is the result of an independent investigation by the FBI.  Waller made a court appearance Friday afternoon in front of a federal judge.

Waller will be back in court September 8th.  He's also scheduled for a preliminary hearing September 16th.

Associate Circuit Judge Scott Thomsen reduced Waller's bond in August to a $27,000 surety bond, which could be paid by a bail bondsman.

He was being held on $55,000 cash only bond on felony stealing charges, and $10,000 on misdemeanor harassment charges.

Prosecutors argued against the bond reduction, claiming that Waller would leave the area if he posted bond, and that he had made threats against the family of his estranged wife, Jacque Waller.

However, Waller's attorney said the Jacque Waller case is irrelevant, and ultimately his motion for bond reduction was granted.

While Clay Waller is not a suspect, he is a person of interest in the disappearance is his estranged wife.

She went missing on June 1. 

At this point, no arrests have been made in that case, and Waller remained in custody of U.S. Marshals.

The Cape Girardeau attorney says at some point this becomes vindictive prosecution.

Reynolds says Clay's life has been threatened a number of times on various social networking sites, and now's a good time to look at having charges brought against those people.
