Waller pleads guilty to Internet threatening

CAPE GIRARDEAU, MO (KFVS) - Clay Waller pleaded guilty Monday afternoon to a federal charge that he made an Internet threat against his missing wife's sister.

Waller told the judge, "I sent the email.  I did it."

Waller's estranged wife, Jacque Waller, has been missing for more than four months.

The hearing Monday was in U.S. District Court in Cape Girardeau.

Jacque's sister, Cheryl Brenneke, issued a statement to Heartland News after Clay Waller's guilty plea.  "Glad we don't have to worry about him showing up til sometime in December.  Also gives us more time to find her (Jacque). Hope he never walks free another day of his life."

Waller was married to 39-year-old Jacque Waller. The couple share 5-year-old triplets.

Waller reportedly went to talk to an attorney about a divorce, the day she went missing June 1, 2011. She was last seen near Clay Waller's house.

Clay Waller has been called a suspect by prosecutors in connection with his wife's disappearance, but no charges have been filed. 

However, according to court documents, the Cape Girardeau County prosecuting attorney's office anticipates filing a murder charge against Clay Waller. There is no indication how soon that could happen.

The sentencing date for the federal internet threatening charge is set for December 19, 2011 at 3:30 p.m.

Waller faces up to five years in prison, and a $250,000 fine.

Waller's federal public defender Scott Tilsen decline to comment about the case, but did indicate he was not happy about his client remaining in solitary confinement in Pemiscot County.

Tilsen said, "It's starting to wear on him."

Tilsen's motion for revocation of Waller's detention order was withdrawn. The matter is considered a moot point.

Last month, a federal judge ordered Waller to be held without bond.

Waller will now be held in federal custody until his sentencing.

U.S. Assistant Attorney Larry Ferrell declined comment until sentencing.
