Attorney files appeal on Clay Waller's prison sentence

CAPE GIRARDEAU, MO (KFVS) -

Clay Waller's attorney filed an appeal on Waller's five year prison sentence on Wednesday.

Clay Waller was sentenced to five years behind bars in federal court Tuesday afternoon after pleading guilty to threatening his sister in law on the website Topix last year.

According to court documents, Attorney Scott F. Tilsen is appealing Waller's sentence and application of sentencing guidelines.

U.S. Assistant Attorney Larry Ferrell argued on Tuesday that Waller should get a longer sentence than just the six to 12 months recommended in the pre-sentencing report.

The judge agreed by giving Clay Waller the max of five years behind bars, then three years supervision. He also has to undergo domestic violence counseling.

Waller's attorney Scott Tilsen declined an on camera interview on Tuesday, but said he's disappointed.

"It's not right to sentence a man on a crime he's not been convicted of," said Tilsen. 

No murder charges have been filed by the state against Clay Waller.
