CAPE GIRARDEAU, MO (KFVS) -

A former Cape Girardeau teacher was  found not guilty Friday of assaulting a student.

Roman Smith, who taught science at Cape Central High School, was charged with a January assault downtown.

He was accused of choking a teen until he passed out.

Smith called it a "play fight."

According to the Cape County Prosecuting Attorney's Office the state presented three witnesses, and smith testified in his own defense.

Again the verdict is not guilty.
