CAIRO, IL (KFVS) -

A hearing is underway at the Alexander County Courthouse on a lawsuit over the transfer of prisoners from the supermax prison at Tamms.

The union representing prison workers has sued Governor Pat Quinn and the Department of Corrections due to overcrowding concerns as Tamms prisoners are moved to other prisons.

Tamms Correctional Center is slated to close on August 31.

What the union has done is ask a judge to step in and issue an injection to stop that closure from taking place.

Wednesday morning, the state filed a motion to dismiss the case, saying the money to run Tamms has been cut. Also, that it's the governor's constitutional right to cut the money to run the prison. The state also said the IDOC is paying employees overtime to beef up security at facilities where Tamms inmates have been moved.

The union's AFSME attorney has countered all of those points. The attorney is saying the money is there to run Tamms. And, that the legislature should have its say in this in its fall veto session before any closures take place.

The AFSME attorney says the employees were already working mandatory overtime before Tamms prisoners were transferred.

The state's attorney said on Wednesday morning the state would halt prisoner transfers until at least August 17 in order to give the union time to respond to the motion to dismiss.

A decision is not expected on Wednesday.
