A hearing in Alexander County is the first step in a lawsuit that aims to stop the transfer of prisoners out of Tamms.
Ironically, a motion to dismiss the case filed by a lawyer for the state accomplished that aim, at least for a few days. One of the main goals of the lawsuit is to get a court injunction to temporarily halt the transfer of prisoners out of Tamms.
Union officials with the American Federation of State, County, and Municipal Employees (AFSCME) say the way in which super-max prisoners have been moved from Tamms to other facilities jeopardizes the safety of corrections employees.
The state agreed to halt closure-related prisoner transfers until at least August 17. Between now and then, AFSCME and the state bargaining team will meet in arbitration to discuss safety concerns.
On August 17, both sides will report back to the judge. At that point, the judge can chose to dismiss the case, grant the injunction or deny the injunction.
The state argues the case should be just dropped because it's the governor's constitutional right to cut funding and close facilities.
AFSCME argues they should be granted an injunction to stop the closure. At least until state lawmakers get a chance to uphold or overturn the governor's action in the fall veto session.
