JACKSON, MO (KFVS) -

Clay Waller pleaded not guilty Monday morning in a Cape Girardeau County courtroom.

Waller stood before judge Benjamin F. Lewis for his arraignment on murder and tampering with evidence charges. 

Waller also waived his right to a formal arraignment during Monday's hearing.  He will be in court again on October 22, 2012.

During Monday's hearing in Jackson Waller's Public Defender, Christopher Davis, made a motion for discovery which will allow the defense to review all of the evidence in the case.

The judge is giving the defense until the October court date to review the evidence.

Davis expects to receive the multiple files soon.

"It's going to be a daunting task getting through the mountain of discovery, all the audio and video that is involved in this case," said Chris Davis.

Davis also said he planned to file a change of venue motion in the next couple of days. He said he would sit down with the prosecution and see if they can agree on a venue.

If that doesn't happen the judge will then hear both recommendations on the October 22nd court date, and then make a decision.

Davis also said he expected the judge to set two weeks aside for the trial. The 16 year veteran public defender said he would expect a late spring or early summer trial.

In late July, Judge Gary Kamp ruled there is probable cause to send Waller's case to circuit court.

Prosecutors say Clay Waller killed his estranged wife, Jacque Waller in 2011, and then buried her body.

Her body has not been found.

Waller is currently serving a five year sentence on charges he threatened Jacque's sister over the Internet.
