MARSHALL COUNTY, KY (KFVS) -
The Marshall County Grand Jury will consider a charge of manslaughter in the second degree for a physical altercation that turned deadly last month.
On August 18, Marshall County deputies responded to 1152 Union Bridge Road for a disturbance. Once deputies arrived, Howard J. Baier was found dead in the yard of Jimmy Filbeck.
Filbeck and Baier had gotten into a physical altercation and Filbeck tried to restrain Baier until deputies could arrive at the scene, according to the Marshall County Sheriff's Office.
The final autopsy report concluded that the cause of death was traumatic asphyxiation and manual strangulation, which was consistent with Filbeck's statements given on the evening of the assault.
This matter will be presented to a Marshall County Grand Jury on September 13. Manslaughter in the second degree is a class C felony.
