CAPE GIRARDEAU, MO (KFVS) - A hearing scheduled for Monday that may determine whether the Ku Klux Klan will be allowed to distribute flyers on cars in Cape Girardeau was canceled.  It has not been rescheduled.

The ACLU of Eastern Missouri says Judge John A. Ross will rule on the case sometime before September 28, the day the KKK was originally planning to distribute the flyers.

Earlier this month, the KKK filed a lawsuit in federal court challenging the constitutionality of the litter ordinance in Cape Girardeau.  The current ordinance says flyers can only be placed on cars only if the owners are willing to accept them. 

It is the Cape Girardeau Police Department's policy to arrest those who violate the ordinance.  Violations could result in up to three months in prison, a $500 fine, or both. 

The ACLU attorney representing the KKK says the Klan will not come to Cape if the court rules against their challenge.
