CAPE GIRARDEAU, MO (KFVS/AP) - A federal judge ruled a Ku Klux Klan organization can distribute leaflets in the city on Friday.
Judge John A. Ross granted the preliminary injunction Thursday that was filed by Frank Ancona with the Traditionalist American Knights earlier this month.
Cape Girardeau city leaders denied a request from the Klan to hand out the leaflets saying it violated the city's litter ordinance.
But the judge's injunction prevents the city from enforcing that ordinance and allows Klan members to put the leaflets on cars, something they're set to do Friday.
The Traditionalist American Knights' Imperial Wizard, Frank Ancona, called the ruling a "victory for the First Amendment." He says the ruling is coming at the "last minute" but that the leafleting will proceed anyway.
Attorney Al Spradling says he'll be talking with the city council about the ordinance.
Earlier this month, the KKK filed a lawsuit in federal court challenging the constitutionality of the litter ordinance in Cape Girardeau. The current ordinance says fliers can only be placed on cars only if the owners are willing to accept them.
Heartland News spoke to
someone with the ACLU Friday morning.
She says KKK members won't
say where they'll be in Cape Girardeau on Friday because of safety concerns.
