STODDARD COUNTY, MO (KFVS) -

The Catron, Missouri man accused of shooting and killing his son in May 2012 headed to court Monday for a preliminary hearing.

The prosecution in the case against Charles Goforth called several witnesses including Emily Smelser, a criminologist with the Missouri State Highway Patrol Crime Lab.

Smelser testified that tests showed Charles Goforth had the substance Alpha-PVP in both urine and blood samples. Smelser went on to say that Alpha-PVP is commonly marketed as "bath salts."

Goforth's son, Josh Goforth, also took the stand during the hearing.

He testified that he, his brother Patrick and an acquaintance, Anthony Walley, had been fishing and when they were done they went back to the Goforth's home in Catron, Missouri.

Josh Goforth also testified that he and Walley stayed outside while Patrick Goforth went inside to change pants. Josh says that while they were at the home, Charles Goforth and his wife pulled up behind them and that Charles Goforth went inside the home. Then a short time later Josh Goforth said he heard a gunshot.

Josh Goforth said when he went inside the home he found Patrick shot in the head.

He said he took his brother to the hospital but he didn't survive.

The judge ruled there was enough evidence and bound the case over for trial. Goforth's arraignment hearing is set for October 17th.
