Procecutors want to retry an man who's murder conviction was overturned.
Earlier this month, Missouri's Supreme Court overturned Mark Woodworth's murder conviction, but he's still in custody of authorities.
And on Thursday, the Livingston County, Missouri prosecuting attorney filed his intent to retry the case.
The court ruled that prosecutors withheld evidence that could have been used by Woodworth's attorneys to defend him.
Experts say the officer who killed a Long Island college student and a home invasion suspect on Friday was confronted with a split-second choice.
