SIKESTON, MO (KFVS) -

A proposed bill in New Jersey would allow police to go through driver's cell phone history on the scene of an accident to check if the driver had been using their phone while driving. Here in the Heartland, police can get cell phone records, but not without a subpoena through the court system. 

“If it was a pretty serious traffic crash with disabling injuries or a fatality, prosecutors are pretty good at working with us on that because they want resolution and closure as quick as they can," Missouri State Trooper Clark Parrott said. "We’ve got people that can download just about any kind of phone, whether it’s one of those ole flip phones or the new smart phones. They’ve got software on the computers that can do that.”

Parrott said they will likely only go through the process of getting the records if the crash is serious. However, that does not mean they don't take texting and driving seriously. 

“If someone is lying to us out here on the side of the road, and that’s all we’ve got, we’re probably not going to go get a search warrant for that, the prosecutors probably aren’t going to go for that either," Parrott said. "But, what we will do is address the consequences of that texting a driving, which is the lane violation, you know, a failure to maintain a single lane, that sort of thing.”

Drivers have mixed thoughts on whether or not police should be allowed to access phone records.

“I wouldn’t think he would have the right to look through my phone," Travis Nelson said. "I’ve been guilty of texting, but I still don’t think he has the right to see what I’m texting.”

Other drivers disagree. 

“I would be okay with that," Rebecca McLeroy said. "If I was swerving and they thought I was texting and driving, yeah, I would be okay with that.”

According to the Missouri State Highway Patrol, driving while distracted is the number one cause of traffic crashes among teens and young adults.
