Judge delays decision on Arias sentencing re-trial

PHOENIX (CBS5) -

Judge Sherry Stephens has delayed a decision on a request from Jodi Arias' defense attorneys to delay the sentencing re-trial until January.

Stephens did not rule on the request from Kirk Nurmi and Jennifer Willmott during a status conference Thursday morning and set another hearing for July 18.

Prosecutor Juan Martinez has maintained the re-trial should resume as scheduled this summer.

A jury in early May convicted Arias of first-degree murder in the death of her boyfriend Travis Alexander five years ago.

That same jury deadlocked on whether she deserved life in prison or the death penalty, so Stephens declared a mistrial of the penalty phase.

A new jury was slated to be impaneled July 18, unless both sides agreed to a deal to spare taxpayers the expense of a new penalty phase by taking the possibility of death off the table.

If that happens, Arias would then get life in prison.

Arias was in court, shackled and surrounded by security guards throughout the hearing Thursday.
