2 from Benton, Ky. arrested for unlawful transaction with a minor

Kentucky State Police arrested two Benton, Ky. men on Friday, July 26.

Robert L. Byars, 32, and Theodore F. Byars, 36, were charged with one count of unlawful transaction with a minor third degree.

According to police, the arrests are part of an ongoing investigation of Robert Byars, in which he is charged with various crimes involving a juvenile.

They say Robert Byars has remained incarcerated at the Marshall County Detention Center since his arrest on July 1. The investigation revealed that he was passing letters to his brother, Theodore Byars, who was giving them to a juvenile.

Police say the letters were sexually explicit and were asking the juvenile to meet with him after his release, which would cause the juvenile to disobey her parents.

Robert Byars was previously charged with 15 counts of unlawful transaction with a minor first degree, five counts of sodomy third degree and five counts of rape third degree after his July 1 arrest. The investigation revealed that Byars had been having a sexual relationship with a juvenile. His bond was set at $200,000 cash.

Robert and Theodore Byars are lodged at the Marshall County Detention Center.

The investigation is ongoing by Detective Cory Jessup.
