    The family of a Marine who killed himself after a tour of duty in Iraq has won a bid to reinstate a lawsuit against the federal government over his treatment by two Veterans Affairs facilities in Kentucky.

According to police, Kaylynn Small, a 12-year-old girl from Springfield, died after an apparent drowning in a Vermont river on Saturday night.

Small was staying with her grandmother for the summer.

Police said she was swimming in the river with two friends when she was swept into the river around 5 p.m.

Authorities said they did all they could before nightfall.

"During the course of the night they continued to search," said Winooski Police Chief Steve McQueen. "They placed buoy markers out based upon the last known location, according to the other young ladies that were with her. They searched as long as they could last night until it just got too dark. The river looks fairly calm in the area where they were. It's just that they ventured out a little too far out into the river. People just have to understand that it can be very dangerous."

The search resumed Sunday morning, and Small's body was found just a short distance down river from where her friends said she was swept in.

Small's death is one of at least five river drownings in Vermont this summer.
