COPIAH COUNTY, MS (Mississippi News Now) -

Timothy Burns was arraigned in Copiah County Justice Court Wednesday.  He is charged with arson and two counts of murder in the deaths of 30-year old Atira Hughes-Smith, her 7-year-old son Jaidon, and husband, 34-year-old LaTerry Smith. 

Sheriff Harold Jones says there is a jurisdiction question on one of the murders so they didn't want to charge him yet on third homicide.  

The sheriff would not say which murder may not have occurred in Copiah County.

"We believe that we can prove that two of the victims were murdered in our county, theres a jurisdictional question on the third victim and until our investigation leads us to where that jurisdiction and that murder did occur, then were just going to charge him with two (murders) in our county," says Copiah county Sheriff Harold Jones.

The motive behind the murders and Burn's connection with the victims still remains unclear.

The three murder victims were found Tuesday morning on Shelby road in western Copiah county.  All three died from gunshot wounds according to investigators.

MBI spokesman Warren Strain tells Mississippi News Now, that their investigation has revealed that Laterry Smith may have been killed in Jackson.
