The Sumner County man accused of shooting his wife to death earlier this year appeared in court Friday, and the victim's family spoke out for the first time.

Joseph Cundiff faces a first-degree murder charge after he was accused of shooting his wife, Ashlee Witham Cundiff, at their Hendersonville home the night of Feb. 13.

Officers found Ashlee Cundiff with a single gunshot wound, and she died six days later.

Friday, Joseph Cundiff's attorney argued to move the trial. He also tried to convince the judge to throw out key statements his client told investigators.

In the hours after the shooting, Joseph Cundiff gave inconsistent versions of what happened, though he maintains it was all an accident.

Hearing the details, Ashlee Cundiff's family sat in court and cried.

"Still having a hard time," said the woman's aunt, Missy Whitley. "Holidays are coming up, so it's really difficult for us right now."

Since the shooting, they launched a foundation in the woman's memory. Money raised supports the couple's two children and survivors of domestic violence.

"It's a huge problem. We had talked to her about leaving, and she just wanted her family, you know, that's the most important thing to her was having the family together," Whitley said.

Ultimately, a jury will likely decide whether it was a crime or an accident. Either way, as tough as it may be, Ashlee Cundiff's family promises to watch it unfold.

"I have to be here for her. I just have to be here for her," Whitely said.

Joseph Cundiff remains in the Sumner County Jail. He returns to court next month. If ultimately convicted, he faces the possibility of life in prison without parole.
