MINER, MO (KFVS) -

We learned attorneys for the American Civil Liberties Union filed a lawsuit against the city of Miner.

The lawsuit is on behalf of a homeless couple who say they were threatened with arrest by city officers for holding a sign asking for money.

This incident allegedly happened back in September on the corner of Matthews and Malone in Miner.

The homeless couple named in the lawsuit , Brandalyn Orchard and Edward Gillespie, are Missouri residents.

They claim to travel the state mostly by hitchhiking and now they are suing the city of Miner and two unnamed police officers.

In the court documents, the couple said they were holding a sign saying, "Traveling. Anything helps. God bless," when a police officer approached him.

The officer allegedly told them that begging is illegal even brought them highlighted copies of city ordinances.

Orchard and Gillespie say they left town and haven't returned. Their attorneys did reach out to city officials about a month later asking what ordinances are in place against begging and loitering.

The city clerk responded in writing by saying the city doesn't have any policies in place.
