ASU's legal counsel Judge U. W. Clemon resigns

Alabama State University announced on Wednesday that Judge U. W. Clemon is resigning as the university's legal counsel.

ASU released a statement saying Clemon resigned as the University's legal counsel for the FSS audit and all other legal proceedings.

Clemon's pay was the subject of heated debate since, as a former federal judge, he was being paid $375 per hour to provide ASU with legal counsel.

Clemon's firm oversaw the documents and information requested by the auditing firm Forensic Strategic Solutions during the forensic audit ordered by Governor Robert Bentley.

During that process, Clemon's firm racked up at least $200,000 in legal fees. Documents obtained by WSFA 12 News show ASU spent over $300,000 in a lawsuit against FSS

This is the latest resignation at Alabama State University following two years of turmoil. Elton Dean, the chairman of the board of trustees, resigned at the end of last month at the request of the governor.

Vice-Chairman Marvin Wiggins was removed from the board by the Governor after he refused to step down. Both of those men were named in the audit report as having financial conflicts of interest with the university in which it is alleged that member of their families benefited financially from the university. Both men deny the claims.

Alabama State has seen its credit downgraded by Moody's three times in 2014 and has recieved a 6-month warning from the Southern Association of Colleges and Schools Commission on Colleges.

"While we respect ASU's right to reject the advice of its retained attorneys, we are much concerned that the rejection of our recommendation has directly resulted in the further downgrading of ASU's bonds and related problems," Clemon wrote. "Under these circumstances, we are compelled to termination of our representation of ASU on FSS-related matters."
