MAGNOLIA, AR (KSLA) -

Columbia County law enforcement held a press conference Friday where they announced they plan to upgrade the charges of the two men accused of fatally shooting a Southern Arkansas University student and an alumnus.

Authorities plan on upgrading 23-year-old Timothy Johnson's charge from terroristic act to first degree murder. They plan on upgrading 20-year-old Byron Lavell Dunn's terroristic act charge to capital murder.

Deputies said they believe Johnson and Dunn were the only two firing weapons Sunday night at the VFW hall when they shot and killed SAU football player Brandon Hobdy, 23, and SAU alumnus Wayne Payton II, 24. Authorities added Friday that one other victim was struck, but the person did not receive medical attention.

Local law enforcement reported that several people were kicked out of the venue after a dispute erupted. They then got into a red vehicle, pulled out a weapon and began shooting indiscriminately at the crowd.

Johnson made his first court appearance Friday. His family held signs at the press conference in support of his innocence. The signs read phrases such as "#InnocentUntilProvenGuity" and "#FreeTimmy." 

"I can't believe they would say this," said Johnson's mother, Terrie Johnson. "My son was shooting. He is scared of guns. He is scared of everything, and you say he is shooting. It's just unbelievable."

"We know he is innocent, everybody from Camden, Arkansas, Queen City," said Demetrius Moore, who identified himself as a friend of Johnson's. "I saw everything that happened." When asked whether Johnson had anything to do with it, Moore said, "Had nothing to do with it." 

Both men are each being held on a $1 million bond. The investigation remains ongoing.
